Rights of Publicity For All - Model Releases in Foreign Countries

In general, you may photograph people when they are in public. The use of those photographs, however, can be restricted due to certain privacy rights. Privacy rights are recognized in most states, but are different for each one. Since its tricky to know what you can do, the safest approach to follow is the most restrictive one.

One right of privacy also known as the right of publicity is the commercial appropriation of someones name or likeness. It happens when the name or likeness of someone is used without consent to gain some commercial benefit, such as when a photograph of a person is used in an advertisement without the persons permission. That is why model releases are so important. It is evidence that you have the persons permission to use his image for certain purposes.

So what do you do when you travel to foreign countries to photograph the people there? Do you need a model release? What if the people dont speak English?

Nevada Wier has published thousands of travel photographs from all over the world. Her advice in her book, Adventure Travel Photography, is:

"If you plan to use your photographs for publication or stock, I think it is wise to have signed model releases from any people you photograph in a foreign city, no matter what their nationality or what the shooting situation is. (Even though lawsuits aren't currently common in the rest of the world, this might change.) Translate your release forms into the language of the country you'll be traveling and photographing in. In more remote regions it is a bit trickier to get signed model releases, and not always appropriate. People may be suspicious, confused or frightened if they're asked to sign a piece of paper. Use your common sense."

Understanding Your Legal Rights in Florida

There is much to consider in being charged with a crime; Appointment of legal counsel, education of rights, and preparing to possibly stand trial. If you are being investigated or charged for a crime, such as assault or battery, homicide, a felony, or a weapons charge, there is a long road of financial and legal turmoil ahead.

Often Assault and Battery are coupled together for relation in nature. It's possible to be charged solely with assault, battery generally encompasses assault. Assault is the intent or threat to commit a violent act against another person. There are two classifications of assault, aggravated and simple. Aggravated is more severe as a third-degree felony and is punishable by five years in prison. Simple assault is a second degree misdemeanor and is punishable by 60 days in jail. Once an act of violence has actually occurred, the crime becomes battery. Florida law consists of three types of battery, simple, felony, and aggravated. Simple is punishable by up to 1 year in jail and is a first degree misdemeanor. Felony consists of a maximum of 5 years in prison and is a third degree felony. Lastly, punishable by up to 15 years in prison, aggravated battery is a second degree felony.

Defined as the unlawful killing of another person, homicide is broken in two categories murder and manslaughter. Various degrees of murder exist based on if a crime is considered premeditated. Manslaughter is unintentional death caused by preventable or avoidable negligence or recklessness.

Felonies are often confused with misdemeanors, but generally felonies carry more severe and long term consequences. Several types of felonies exist with varying degrees of seriousness. Specialized legal counsel is available regarding your case type.

As a result of an arrest for involvement with weapons and guns, serious legal and financial consequences will follow. Possessing a gun while committing a crime carries a 10 year mandatory sentence. If a gun is fired during the commission of a crime, there is a 20 year sentence. If a person is shot during the course of a crime there is a 25 year minimum sentence.

Venture Lending: Babson MBAs Get the Low-Down on Venture Debt Financing

Recently, several students from the Babson College MBA program called requesting an interview. They were researching the venture debt market and wanted an insiders view of how this segment compares with venture capital. Their questions were thoughtful and I thought the discussion was worth sharing. An excerpt from the interview appears below:

Q. How does venture lending (VL) differ from venture capital (VC) as it relates to fund- raising expenses?

A. Fund-raising expenses in connection with venture loans are generally lower than for venture capital transactions. Legal fees are one of the largest expenses in many transactions. Lenders typically negotiate venture loan arrangements using their standard documents. Venture capitalists, however, usually use newly created stock purchase agreements. These agreements add considerable expense to these transactions since outside legal counsel is used. Other VC expenses include a more expensive and comprehensive due-diligence process.

Q. What about the flexibility of agreement terms?

A. It is difficult to compare the flexibility of terms between the two forms of financing. Flexibility can vary from lender to lender and from VC to VC. Generally, venture capital is a more flexible form of financing than venture debt since the proceeds are allowed to be used for many purposes. Usually, no collateral is required and there are fewer agreement covenants than lenders require. Venture loans often limit the use of proceeds to the acquired capital assets or for specific working capital purposes. Venture lenders usually require collateral and they may incorporate several covenants and conditions into their loan agreements.

Q. Are there VL companies that focus on segments other than technology or life sciences (e.g., retail, restaurants)?

A. There are not many venture lenders that specialize outside of those areas at present. The universe of venture lenders is relatively small, particularly in comparison to the VC industry. There are probably fewer than thirty U.S. firms that specialize primarily in venture lending or leasing. Most are involved in the segments that you mentioned.

Q. How much time does it normally take to get money from a venture lender? How many visits does an entrepreneur have to make to a venture lender before a final decision is made?

A. Most venture loans take at least thirty days to complete from the point of meeting the prospect to actual funding. Completion time can range up to sixty days or more, depending on the complexity of the credit. Most lenders will meet with the prospect a few times before committing.

Q. Can an entrepreneur continue window-shopping if a venture lender has started due-diligence?

A. Yes, but lenders frown upon shopping because of the time they commit to processing the transaction. The norm in the business is to bind a transaction with a commitment letter and fee. If the borrower/lessee continues shopping and chooses another provider, the fee is usually forfeited.

Q. Ideally, at what stage would an entrepreneurial company be considered safe for venture lending (e.g., a startup seeking the first round of financing or a company that already has a first equity round and is seeking a second round)?

A. Most venture lenders get involved after the company has successfully raised at least $5 million or more from a reputable venture capital sponsor - that is, after the A round.

Q. What are collateral requirements for a growth capital loan?

A. Collateral requirements vary. Some venture loans/leases are collateral specific. The lender requires collateral in the form of the equipment being financed. Other transactions are more flexible, allowing the proceeds to be used for general growth purposes and working capital. In the latter arrangements, the lenders may require an all-asset (blanket) lien on the borrowers assets.

Q. Would venture lenders invest in a company not sponsored by VCs? Are there any exceptions?

A. Generally, venture lenders invest only in companies backed by VCs or reputable investors with future capital to commit. The reason these sponsors are needed is that the enterprise usually is not approaching the point of profitability and will require additional funding rounds. There are exceptions and it depends on the other strengths of the credit. For example, a particularly strong cash position and strong collateral can entice a lender to relax the requirement of ongoing VC support as long as the lender has confidence in the management team. Other factors may also influence the decision.

Q. What are the top four or five characteristics that you consider before deciding whether to finance a startup?

A. We look for talented and experienced senior managers, strong VC sponsorship from reputable VCs, a compelling business plan and enterprise track-record since inception, an acceptable cash position and burn-rate, and acceptable collateral quality.

How To Fight A New York Speeding Ticket at the Traffic Violations Bureau

The first step is to compute how many points are involved with the New York State speeding ticket you have been given.

The following chart will help you figure this out:

1 - 10 mph over speed limit - 3 points

11 - 20 mph over speed limit - 4 points

21 - 30 mph over speed limit - 6 points

31 - 40 mph over speed limit (possible suspension) - 8 points

More than 40 mph over speed limit (possible suspension) - 11 points

Points are measured from the date of offense (even if you are convicted years later). So when adding the possible points for a newly issued speeding ticket. you must go back 18 months from the date of the new ticket and determine how many other points you have on your record. Also, three speeding convictions within 18 months will result in an automatic revocation in your driving privileges for 6 months.

The next step is to determine whether your case is returnable at a Traffic Violations Bureau (TVB) court or not. There are two, very different traffic court systems in New York State and, therefore, this determination is important for you to understand what you can and cannot do. If you are not within the TVB, then usually you can resolve the case by a plea deal.

The TVB courts cover any New York traffic ticket issued in New York City (Manhattan, Bronx, Brooklyn, Queens and Staten Island), western Suffolk, Buffalo and Rochester. A New York speeding ticket issued in any other place within New York State will not be a TVB court.

The reason this is an important inquiry is that TVB courts generally do not allow any type of deal-making or plea bargaining. Rather, you must either plead guilty or not guilty and, if you plead not guilty, you are given a hearing where you will either win or lose. In this "all or nothing" court, it really pays to retain an New York traffic lawyer to fight your case. That is, a New York traffic attorney who is experienced and knowledgeable in fighting speeding tickets at the TVB. Putting aside the emotions involved with fighting your own case, most motorists do not know how to listen carefully or cross examine. Rather, they basically ignore the officer's testimony, fail to ask any questions and, instead, just tell the judge their story. This incomplete approach is not recommended and is clearly not effective.

If you do fight your own TVB speeding ticket, listen carefully to the officer's testimony and even take notes. If the officer omits critical testimony (ex., date, time, location, direction, your ID information), then point this out to the judge after the officer rests. Similarly, if the officer gives testimony which is inconsistent with his other testimony or the information on the ticket, then likewise point this out to the judge.

For instance, I once was fighting a NYC speeding ticket when the officer testified that the motorist was proceeding east bound on the Long Island Expressway. The ticket, however, indicated W/B or west bound. After the officer rested, I showed the ticket to the judge who promptly dismissed the case.

Even without an omission or inconsistency, you should still ask thoughtful questions of the officer. For example, if your defense is that the officer pulled over the wrong car, then ask him where was he when he first saw your car, did he have to pass any other cars to apprehend your car, and how long did it take him or apprehend you. These types of questions build on your defense.

Also, ask to the see the officer's notes. Read them and determine whether his notes are consistent with his testimony. Any discrepancy should be pointed out to the judge. Also, do not be afraid to ask the officer to decipher illegible portions of his notes.

After your cross examination of the officer, it is time for you to offer your defense. Speak slowly and clearly. Hand up any evidence supporting your defense such as photos, witness statements or diagrams. Keep in mind that the judge hears many, many such cases and, therefore, you should not be repetitive or rambling about irrelevant information.

One last tip. Prior to fighting your case, watch the judge and how he handles other cases. Does he listen and take notes? Does he seem impatient or distracted? If you are concerned about whether you will get a fair hearing, ask for a new date. It is unlikely that you will get the same judge on the next assigned date.

You should also consider buying a car that has air bags and automatic seat belts. Believe it or not, some car insurance companies actually discount to 30% off Personal Injury Protection and Medical Payments coverage.

Green Tea - Why it's Good for Mesothelioma

One of the rarest forms of cancer is the mesothelioma cancer. This is a form of cancer that affects the lining of the lungs but it is different from lung cancer. It does all this because green tea greatly improves the immune system which is the body's natural army against illnesses.

Finding Hidden Assets

If you have a judgment against an individual, most likely you are not going to find any attachable assets by searching public records. Judgment debtors are smart. They know you are looking for their bank accounts. Most of them do not have open checking/savings accounts in their name.

In recent years, the internet has been a great place to hide money. PayPal for example allows individuals to have online accounts to either store funds or make business transactions. A high percentage of Ebay users have PayPal accounts. Many online businesses use PayPal as a form of accepting credit cards. If you believe your debtor has a PayPal account, here is what you do:

Have your attorney send a letter via U.S. Certified Mail or by courier service (Fed Ex, UPS, etc..) to PayPal with a subpoena (or writ of attachment if you have a judgment) to the following address:

Make sure the subpoena/writ includes the debtors full name, address, social security number. It wouldn't hurt to include the email address of the debtor.

Another way to search for someone assets is to check their trash. I always tell my clients to shread their personal information before they throw it away. However, there are still many careless people out there who just throw away their bank statements, stock portfolio, telephone bills, etc...

In most cities it is legal to search through someone's trash as long as the containers are on the street or in the alleyway. I suggest checking with the city regarding their laws before you take someone's garbage.

There are many other creative ways to find hidden assets. I won't list them all here. The above steps are probably the best way to start when you need to collect on a sizable judgment.

Medicare Benefits - For Whom Does It Fit?

Among the benefit programs of the government, the most applicable one for the retirees is the medicare benefits. However, most of us do not understand the fundamentals of the medicare program. How does the government establish it? How can we benefit from it? This write-up will try to educate those who are in need of such basic and essential information about medicare benefit. This will also serve as a guide for those who are planning to retire and apply for the said program.

Primarily, the medicare is one of the products of former U.S. President Lyndon B. Johnsons Great Society idea which was signed into a law on July 30, 1965 as an amendment to the Social Security laws. Hence, this plan aims to impart the senior citizen of the U.S. a stable and effective healthcare system which will greatly support their medical needs. But, the medicare benefits can also be given to those individuals who are disabled and not only to those who have reached the retirement age of 65 years provided that they have met the requirements set by the Social Security Agency.

In order for a disabled individual to qualify for the medicaid benefits, he or she is required to file an initial claim for title II benefits to the nearest Social Security Administration office. Title II is under the title 2 of the Social Security Act which is commonly known as the social security disability benefits (SSD). This benefit is handed over to disabled individuals who fail to meet the standard income.

Once the claimants applications for SSD benefits were approved, they will be able to receive their medicaid benefits after two years prior to the date of approval. This would mean that they will be ensured of financial support from the government for their daily basic needs.

On the other hand, medicare benefits are given to those who are disabled or have already reached their retirement age regardless of their income. This is different from supplemental security income and medicaid benefits which are basically needs-based programs. The medicare has the following coverage 1) Medicare part A covers hospital visits and staying in nursing homes; 2) Medicare part B covers outpatient care and services which may include doctor visitations, laboratory reports and x-rays; and 3) Medicare part D covers prescription drugs. This, however, is only available for those who are already eligible for medicare part A & B benefits.

The medicare program of the government has some complicated aspects. If the petitioner still finds the process of applying for the said benefits, then, it is very much recommendable to hire the expert assistance of a qualified social security attorney to help them in pursuing their claims. This will ensure them of acquiring their much needed financial support from the government.
